Here’s what you need to know to stay legal and neighbor-friendly in Virginia Beach.

Do You Need a Permit for Tree Removal in Virginia Beach?
In most residential areas, you typically do not need a permit to remove a tree that is located entirely on your private property.

However, a permit may be required if:

  • The tree is part of a city easement or public right-of-way
  • The tree is on or near a protected area – for example, within the Chesapeake Bay Preservation Area (CBPA)
  • The property is governed by a neighborhood HOA

  • Timber Trespass – Under Virginia’s Timber Trespass Code (§ 55.1-2821), cutting down or damaging a tree on someone else’s property, even accidentally, could result in a lawsuit for triple damages plus legal fees. This applies whether the tree was cut by you personally or by a tree service you hired.
